Clinical Negligence Overview

What is Clinical Negligence, and how can MPH help with a Compensation Claim?

When we are ill or have suffered an injury, we submit fully to the direction and care of medical professionals, usually in a hospital. We trust the quality of the equipment they use, the standard of personal care, and above all, their professional judgment. In the vast majority of cases this system works well, and patients are given a very high standard of care. In a relatively small number of cases, medical professionals can sometimes get it wrong; this can result in clinical negligence.

Medicine is very complicated, and an ever evolving discipline which requires high standards of intelligence, critical awareness, and the ability to work well under pressure. Those that practice in a medical environment, though they may be very competent, are still human and therefore liable to make mistakes.

If you have received medical care and treatment, and as a result have suffered further injury or illness, then you should consider whether this was due to any clinical or hospital negligence

If you do feel that this was because of clinical negligence, then you should begin investigating the legal channels which are open to you to be compensated for your suffering.

Clinical Negligence is simply a mistake that was made by a medical practitioner. This can be anything from a failure to correct the diagnosis or illness, condition or injury, to the use of defective or inappropriate medical equipment. The key thing with a legal clinical negligence claim, is that these mistakes have led to further illness, injury or suffering on your part.

Claiming Compensation

Winning a clinical negligence case isn’t easy. It requires a huge amount of investigation and a good deal of evidence to establish that treatment or diagnosis was incorrect or fell below a standard regarded as acceptable.

Because of our experience and expertise in this area, and our specialist knowledge of treatment and procedures, we can make a sensible assessment of your case, to assess whether or not we think we can win, and what you might expect to receive in compensation.

The first thing we will do is talk through your case in detail. Our Partners, Frank Patterson and Mark Havenhand, head up our team of exceptionally experienced Solicitors and support staff who handle all types of clinical negligence claims, including cases involving catastrophic injuries to infants, fatalities from cancer misdiagnoses, and other medical claims.

If we do not think your case has adequate evidence, or we find that a responsible body of practitioners would act in the same way in the circumstances, we will let you know as soon as possible.

However, if you feel you have a case, then we are the people to win it. MPH is ranked as the leading firm in the North West for Claimant Clinical Negligence by the Legal 500 2010, and Chambers and Partners 2011.
