Case Study

Damages recovered for failure to treat kidney stones resulting in removal of kidney

The Claimant received £125,000.00 for an unnecessary nephrectomy performed as a result of a failure to diagnose gallstones.

The Claimant had been fitted with an ileal conduit as a child and had been diagnosed as having pre-existing Spina Bifida. Urological follow up was essential. It was relieved, following investigations, that a radiology report of 11 April 2000, showed two small calculi in the lower pole of the right kidney. This was not identified until February 2005. Despite attempts to save one of the kidneys, a nephrectomy was unfortunately required.

The Claimant was left with considerable pain from the surgery she underwent which limited her already reduced mobility, due to her pre-existing condition. A breakdown of damages follows:-
