Obstetrics and Gynaecology
Clinical negligence claims in the area of obstetrics and gynaecology can be a very sensitive and emotional subject for women, obstetric medicine doesn’t just cover pregnancy and birth, it also encompasses other aspects of female health, such as sterilisation operations.
A lot of consultants practising in this area will have sub-specialties, including oncology, fetal medicine and reproductive medicine, to name but a few.
If an operation is performed badly, or treatment given incorrectly, it can have painful and far-reaching consequences.
Because of the intimate nature of the resulting problems, it can be hard to talk about, so we’ll make sure your case is handled with the utmost sensitivity and discretion. We’ve been making obstetrics and gynaecology claims for many years and have an in-house nurse who helps us establish if treatment has been negligent so that we can pursue your case.
Here are a few examples of the type of cases we have successfully secured compensation for:
- Perineal tears
- Fistulas
- Anaesthetic awareness during gynaecological procedures
- Undiagnosed disabilities
- Surgical errors resulting in iatrogenic injuries
- Childbirth and fertility departments are responsible for over 50% of clinical negligence claims
Case Study
M -v- Bersi Cadwaldadr Trust – Negligent obstetric care resulting in stillbirth
The Claimant recovered the sum of £150,000.00 in relation to poor medical care she received during the course of her pregnancy, leading to a stillbirth on the 18 October 2007.
Allegations of negligence centred upon the fact that there was a failure to detect an abnormal CTG trace, as a result of which the foetus suffered foetal hypoxia and subsequently died. The Post Mortem report confirmed that hypoxic brain disease had been noted for at least “several hours”, before delivery.
The Claimant suffered moderate level PTSD, including a moderate level of depressive disorder.
The Claimant was unable to return to her position as a Midwife at the Defendant Trust, and damages reflected an award for pain, suffering and loss of amenity, loss of congenial employment and past and future loss of earnings including pension.
Liability was admitted in full by the Defendants.
