If you are denied NHS treatment, we can help overturn the decision through Judicial Review.
Finding out that you have cancer or need to undergo a serious medical procedure, causes enormous distress to you and your loved ones, even if your Consultant tells you there is treatment available.
If you discover that the treatment recommended by your Consultant will not be funded by your NHS Primary Care Trust (PCT) because they deem it too expensive, the emotional turmoil can often lead you to feel angry, upset and helpless.
However, there is still hope. MPH can take your case to Judicial Review to challenge the PCT's decision.
Judicial Review is where we as a High Court Judge to review the lawfulness of the decision not to fund the treatment your Consultant says you need.
Often the key to successfully challenging the PCT's decision comes down to having the right experts for the case. At MPH, we have vast experience in clinical law. We have strong connections with the best Barristers, as well as world renowned doctors who not only excel in medical practice, but are also experienced at giving evidence in legal cases.
Obviously, time is of the essence, and you only have three months from the PCTs final decision not to fund your treatment in which to bring your claim to the Court. We will work quickly to bring your case to Court as soon as possible. At a time when you're no doubt feeling at your most vulnerable, bewildered and under immense stress, we will make sure that you and your family are treated with the utmost care, sensitivity and consideration.
The first thing to do is get in touch. We'll assign one Solicitor to carefully advise you on the options, analyse your claim and suggest the best course of action for you. Your Solicitor will also talk through the funding options with you, including Legal Aid and discuss which is most appropriate for you.
