Court of Appeal Rule on obvious failings at Inquest

The Court of Appeal have today considered a Coroners failure to make Rule 43 safety recommendations in the Inquest into the death of Keith Lewis.

The Court of Appeal criticised the Coroner's failures to make this report in the light of obvious failings found after this death in custody which might have prevented the death. The lack of equipment, training and effective procedures shown by the undisputed evidence led their Lordships to conclude that a report was warranted if the purpose of Article 2 (Right to Life - Human Rights) was to be respected.
