Trish joined our personal injury department in August 2008 and assists Dominic Hemsi with his caseload of industrial disease claims, including asbestos related disease. Her sensitive approach is vital to her role, as she works closely with clients, dealing with the day to day issues that arise during cases.
Witness evidence is a vital part of industrial disease claims, helping us establish the facts of a case, and Trish spends a lot of her time speaking to witnesses and taking statements.
Trish is currently investigating the identity of the defendants in a number of asbestos disease claims against former employers.
As symptoms of these diseases do not develop for many years after the exposure has taken place, it is very often the case that the former employer/company has ceased trading by the time the diagnosis is made.
In order to pursue a claim against a former employer who is no longer trading we have to trace the Employers’ Liability Insurance policy for the relevant period of employment.
Since 1999, there has been a facility to search for Employers’ Liability policies through the Employers’ Liability Code of Practice tracing service. This service has enabled around 20,000 claimants to pursue claims against dissolved companies.
In April 2011, this service was replaced by the Employers’ Liability Tracing Office which was introduced to make it easier to search for the policies using a central online database. The improved database contains new and renewed policies from April 2011, and policies that were identified through the previous tracing service.
Upon successfully identifying the Employers’ Liability Insurance policy it enables us to carry out further investigations surrounding a potential claim for compensation with the appropriate insurers.
Trish is currently studying the ILEX Level 6 Professional Higher Diploma in Law and Practice which is the second and final academic stage towards becoming a Legal Executive.
