Slips, trips and falls

Slips, trips and falls can happen to anyone, anywhere and at anytime. Local Authorities, Highway Agencies and all public and private organisations have a duty of care imposed upon them by law, which places them under an obligation to ensure that their pavements, roads and premises are safe for the general public and lawful visitors to use.

Personal injury claims for trips and slips can be complicated and often difficult to pursue. It is necessary to prove that the Local Authorities and Highway Agencies who are usually responsible for the upkeep of roads and pavements have a satisfactory inspection and maintenance regime in place.

Private organisations owe a duty of care to customers as soon as they enter their premises and should have a system in place to ensure that accidents do not happen. This should involve regular checks of floors and other risk areas where accidents could occur.

Tripping and slipping claims can initially involve multiple Defendants and it will be necessary to prove whether the systems of inspection maintenance and repairs in place are adequate for each of the Defendants. If they are, Local Authorities and Highway Agencies can have a complete defence to a claim for Personal Injury. Similarly if a private organisation can show that they have a reasonable system of checks in place they too can have a defence to a claim.

It is therefore vital that you obtain the right legal advice at the earliest opportunity. Our expert solicitors will be able to check whether the Defendant against whom a claim is being pursued has the right systems in place and more importantly whether these systems were implemented. They will be able to guide you successfully through the legal maze that surrounds tripping and slipping claims and get you the compensation that you are entitled too.
